Employee alleges car wash failed to pay overtime

NEW ORLEANS — An employee is suing a Plaquemines Parish car wash business, alleging failure to pay overtime wages. 

Derek Lafrance of Plaquemines Parish filed a lawsuit May 13 in U.S. District Court for the Eastern District of Louisiana against Concel Enterprise LLC, doing business as a Soft Touch Express Car Wash & Lube alleging, alleging failure to comply with Fair Labor Standards Act provisions regarding overtime pay.

According to the complaint, beginning in April 2015, Lafrance has worked for 60 hours per week without receiving overtime compensation for the extra 20 hours. On a few occasions after complaining, the suit says, he received pay for the partial hours at a rate of his regular hourly rate, not one and one-half times his regular hourly rate as required by FLSA. 

The plaintiff alleges the defendant failed to pay proper overtime wages and minimum wage as defined and required by FLSA.

Lafrance seeks a trial by jury, declaration the defendant's acts and practices violate the law, permanently restraining defendant from engaging in such unlawful practices, compensation for unpaid wages, interest, liquidated damages, attorney fees, legal costs and any such relief the court deems proper.
