Couple claims that a neighbor's home construction caused damages

GRETNA – A Jefferson Parish couple is seeking damages following an incident in which a neighbor's home construction allegedly caused damages to their home.

Stephen Juge and Lydia Anne Juge filed a suit against Tag Homes Inc., Daniel Burke, Emily Burke, ABC Insurance Co. and XYZ Insurance Co. in the 24th Judicial District Court on May 9.

According to the claim, the plaintiff's neighbors, the Burkes, entered into a contractual agreement with TAG Homes Inc. on June 16, 2014, for the construction of a home at the address of 305 Magnolia Drive, Metairie. Though TAG Homes constructed the home, it allegedly failed to do so in a way that would not cause harm to the Juge's property. The suit states that on May 4, 2015, Anne Juge was informed of damages to her home that had been allegedly worsening over time due to the actions taken in the construction of the Burke home through the use of pile driving.

The defendant, TAG, is accused of negligence in completing the work in a responsible manner, as well as absolute liability on the part of the Burkes, which resulted in damages to the plaintiffs' property.

The plaintiffs are seeking an unspecified amount in damages. They are represented by Salvador I. Bivalacqua of Galante and Bivalacqua in New Orleans. The case has been assigned to Division J Judge Stephen C. Grefer.
