GRETNA – A surviving beneficiary is seeking damages, claiming that the Ochsner Medical Center was responsible for the wrongful death of his benefactor.

Vichaun Porter filed a suit against Ochsner Clinic Foundation, doing business as Ochsner Medical Center Main Campus, in the 24th Judicial District Court on May 4.

According to the claim, Lionel Porter was admitted to Ochsner's emergency department on July 7, 2013, when he complained of hip pain. The suit states that over the course of the next several weeks, Porter was treated by the medical personnel at Oschner, but was ultimately not given the treatment that he required. The suit further states that the alleged deviation from normal treatment contributed to the death of Porter on Sept. 24, 2013.

The defendant is accused of deviation from the applicable standards of care through the failure to administer the correct medication, failure to properly assess the patient's condition, failure to monitor, document and assist with the patient.

The plaintiff is seeking an unspecified amount in damages. He is represented by Briana F. Whetstone and David A. Bowling of The Bowling Law Firm in New Orleans. The case has been assigned to Division B Judge Cornelius E. Regan
