Woman claims she was injured when she choked on doughnut

GRETNA – A Jefferson Parish woman claims she choked on a doughnut provided by financial institution and was injured.

Lisa Matthews filed a suit against Terrytown Cafe Inc., Arch Insurance Co., Capital One Financial Corp. and Travelers Property Casualty Co. of America in the 24th Judicial District Court on May 5.

According to the claim, Matthews was a guest at the Capital One located at 3800 General DeGaulle Drive in New Orleans when the incident occurred on May 5, 2015. The suit states that while eating a complimentary doughnut, provided by Capital One, she was caused to choke by a foreign object that was inside the pastry, which was manufactured by Terrytown Cafe.

The defendants are accused of negligence through their failure to provide food safe for their customers to consume, failure to warn customers of associated risks, and general inspection of the food provided to customers.

The plaintiff is seeking an unspecified amount in damages. She is represented by Pierre F. Gaudin of Gretna. The case has been assigned to Division J Judge Stephen C. Grefer.
