Ex-Home Depot employee accuses Aetna of breaching fiduciary duty

NEW ORLEANS — A St. Tammany Parish man is suing Aetna, alleging breach of fiduciary duty. 

Corey Buckley filed a lawsuit May 17 in U.S. District Court for the Eastern District of Louisiana against Aetna Life Insurance Company alleging the plan administrator violated the Employee Retirement Income Security Act.

According to the complaint, Buckley did not receive total disability benefits as defined by the plan and his Aetna insurance policy after he sustained an injury from his job at Home Depot. The plaintiff alleges Aetna Life failed to pay the total disability benefits to which he is entitled under insurance policy and denied his claim for benefits on administrative appeal March 1.

Buckley seeks trial by jury, judgment against defendant, legal interest, costs and attorney fees and all equitable relief as the court grants. He is represented by attorney J. Price McNamara of Baton Rouge.
