NEW ORLEANS — An Alabama man is suing a number of pharmaceutical companies, alleging their drug caused him to suffer painful side effects. 

Billy Clarence Songer of Walker County, Alabama, filed a lawsuit May 17 in U.S. District Court for the Eastern District of Louisiana against Janssen Research & Development LLC, Janssen Ortho LLC, Janssen Pharmaceuticals Inc., Bayer Healthcare Pharmaceuticals Inc., Bayer Pharma AG, Bayer Corporation, Bayer Healthcare LLC, Bayer Healthcare AG and Bayer AG, alleging product liability, breach of implied warranty, fraudulent misrepresentation and concealment.

According to the complaint, Songer began using Xarelto in or about July 2013 and suffered epistaxis bleeding and gastrointestinal bleeding June 2, 2014 and Aug. 26, 2014. At the time of his injury, the suit says, he was taking Xarelto as prescribed. 

As a direct and proximate result, the complaint states, Songer has suffered and will continue to suffer harm and damages including severe pain and suffering, past and future medical expenses. 

The plaintiff alleges the defendants designed, researched, manufactured, tested, advertised, promoted, marketed, distributed and sold Xarelto, failed to properly investigate, research, study and define the safety of the drug's profile, failed to adequately test it or provide adequate warnings, failed to disclose the need for dose adjustments and failed to provide adequate instructions for the drug's use.

Songer seeks a trial by jury, judgment of more than $75,000, medical expenses, pre-judgment and post-judgment interest, punitive damages, attorney fees, expenses, costs and further relief as the court deems proper.
