Cyclist alleges he was injured in accident with truck

GRETNA – A Jefferson Parish man is seeking damages, claiming that he was hit by a careless truck driver while riding his bicycle.

Marco Tobar filed a suit against Jesus Gonzales-Espinoza, Zito Cos. LLC and ABC Insurance Co. in the 24th Judicial District Court on May 13.

According to the claim, Tobar was riding his bicycle on the designated bike path located at Shrewsbury and River Road in Jefferson on May 29, 2015, when the incident occurred. The suit states that while riding his bike, he was struck and caused injury by a truck which turned to cross the path. The truck was being driven by Gonzales-Espinoza, an employee of Zito Cos., at the time of the incident, the suit states.

The defendant is accused of negligence in failing to keep a proper lookout, failing to see the biker, reckless and careless driving and failure to yield to the biker.

The plaintiff is seeking an unspecified amount in damages. He is represented by Michelle D. Robert and Jennifer G. Ahner of the Law Offices of Michelle D. Robert of New Orleans. The case has been assigned to Division G Judge E. Adrian Adams.
