GRETNA – The Pennsylvania Higher Education Assistance Agency is seeking damages, claiming that a Metairie man has not made payments on a loan.

Pennsylvania Higher Education Assistance Agency filed a suit against Jose J. Figueroa in the 24th Judicial District Court on May 11.

According to the claim, Figueroa obtained a loan and executed a promissory note in 1994 for the amount of more than $76,000. Following this, the note was sold to Star Bank, though Figueroa is not involved with the agreements for the transfer of the note's ownership, the suit states. One of the requirements of the note was that the defendant would make monthly payments, but since Dec. 23, 2015, PHEAA claims it has not received a payment from Figueroa. Despite demands for payment, Figueroa has allegedly failed to respond, thus breaching his obligation.

The defendant is accused of outstanding payments and breach of obligation.

The plaintiff is seeking the principal amount of $13,399.30 owed, plus interest. The plaintiff is represented by Bradley C. Knapp of Locke Lord in New Orleans. The case has been assigned to Division J Judge Stephen C. Grefer.
