Former employees allege landscaping service owes overtime

LAFAYETTE — Five former employees are suing a New Iberia landscaping business, alleging failure to pay overtime wages.

Seth Maturin, Benjamin Bernheisel, Dustin Boutte, Gaige Touchet and Tommy Walker filed a class action lawsuit, individually and on behalf of all others similarly situated, May 23 in U.S. District Court for the Western District of Louisiana against Nature Works and Eric L. Landry, alleging violation of the Fair Labor Standards Act and the Louisiana Wage Payment Act.

According to the complaint, the plaintiffs have not received the overtime premium for all time they worked in excess of 40 hours a week. The plaintiffs allege the defendants regularly required or allowed their employees to work more than 40 hours a week, failed to pay the overtime premium of one and one-half of the regular rate and failed to maintain adequate records documenting wages owed.

The plaintiffs seeks a trial by jury, injunctive relief ordering the defendants to end all of the illegal pay practices, compensation for damages, liquidated damages, prejudgment interest, costs, reasonable attorney fees and such other relief as the court deems proper. They are represented by attorneys Patrick S. Almonrode and Jason T. Brown of JTB Law Group LLC in Jersey City, New Jersey, and Timothy W. Basden of Breaud & Meyer APLC in Lafayette.
