Servant's Heart International Outreach files suit over donated properties

Contract 01

GRETNA – A nonprofit organization claims that donated properties were ultimately not given as donations as promised by a Texas couple.

Servant's Heart International Outreach filed a suit against TTC Properties Inc. and Todd and Tracye Cantrall in the 24th Judicial District Court on May 13.

According to the claim, the plaintiff and defendants entered into an agreement on Jan. 1, 2013, in which the defendants agreed to donate three properties in the Jefferson Parish area. Though the properties were "sold" for no money, the plaintiff alleges it did spend more than $30,000 on the process, labor and materials for the properties, as well as hours of labor on demolition. However, the suit states that after the work was done on the properties, the defendants failed to deliver the properties as they had previously agreed to.

The defendant is accused of unjust enrichment, breach of contract, misrepresentation and fraud.

The plaintiff is seeking an unspecified amount in damages. It is represented by Ron A. Austin and Jeffrey P. Green of Ron Austin and Associates in Harvey. The case has been assigned to Division K Judge Ellen Shirer Kovach.
