NEW ORLEANS – An African-American woman alleges she experienced discriminatory treatment at a New Orleans restaurant.

Jolanda Kindell filed a complaint on May 23 in the U.S. District Court for the Eastern District of Louisiana against JRKW Enterprises LLC, doing business as Huck Finn's Cafe, Jeffrey Lester Rogers, Kristian Raphael Wadleigh and Dakota Crochet alleging intentional infliction of emotional distress, race discrimination, negligence and other counts.

According to the complaint, the plaintiff alleges that on May 21, 2015, she dined with a group at Huck Finn’s Cafe. After their lunch, the receipt allegedly contained a notation with a derogatory term referencing her race. They brought the receipt to the manager's attention, and they allegedly received the receipt the second time with the racial slur still present. As a result, she claims she suffered pain, suffering, humiliation, mental anguish, emotional distress and extreme embarrassment.

The plaintiff holds JRKW Enterprises LLC, Jeffrey Lester Rogers, Kristian Raphael Wadleigh and Dakota Crochet responsible because the defendants allegedly failed to create, implement and monitor policies to prevent, stop and rectify such racial discrimination by their employees; failed to properly hire, train and supervise their employees; and failed to maintain an environment free from discriminatory actions and threats.

The plaintiff requests a trial by jury and seeks compensation for all damages, attorneys’ fees, costs and such other and further relief as the court may deem just, proper and equitable. She is represented by James M. Williams of Chehardy, Sherman, Williams, Murray, Recile, Stakelum & Hayes LLP in Metairie and Erica Wright of McMillian & Wright LLC in New Orleans.
