Man files suit against Actos makers over cancer allegations

LAFAYETTE – An Ohio man alleges a prescription drug caused bladder cancer.

Frank P. Griffin filed a complaint on May 23 in the U.S. District Court for the Western District of Louisiana against Takeda Pharmaceuticals America Inc., Takeda Pharmaceuticals USA Inc., Takeda Development Center Americas Inc., et al. alleging strict products liability, negligence, breach of implied warranty and other counts.

According to the complaint, the plaintiff alleges that he used Actos, a diabetes medication, from approximately June 24, 2004, through approximately Dec. 14, 2010. As a result, he alleges the drug caused bladder cancer and he was caused to sustain severe and permanent personal injuries, pain, suffering and mental anguish.

The plaintiff holds the defendants responsible because the defendants allegedly designed, developed, licensed, manufactured, labeled, marketed, distributed and sold Actoplus Met, failed to adequately warn healthcare providers that Actos could cause bladder cancer and concealed from health care providers their knowledge of Actos' propensity to cause bladder cancer.

The plaintiff requests a trial by jury and seeks compensation for all damages, attorney's fees and costs and such other further relief as the court deems just and proper. He is represented by Michael J. Sobieray and David W. Stewart of Stewart & Stewart in Carmel, Indiana.
