Capital One Bank alleges cardholder owes payments

GRETNA – Capital One Bank is seeking damages over claims that a customer failed to pay her balance on her credit card.

Capital One Bank filed a suit against Michelle N. Chubb in the 24th Judicial District Court on May 17.

According to the claim, Capital One Bank issued a credit card to the plaintiff with the agreement and understanding that the plaintiff would make regular payments on the credit card. The suit states, however, that the plaintiff failed to make the agreed-upon payments, resulting in breach of agreement for an amount of more than $4,000.

The defendant is accused of breach of agreement through her failure to make payments on the credit card.

The plaintiff is seeking the $4,085.86 allegedly owed. The plaintiff is represented by Bradley J. Chauvin, Benjamin G. Lambert, Sarena Y. Gaylor, Remy F. Symons, Elizabeth L. Hyman, Jeremy L. Nusloch, Randall C. Roth and Blake J. Guidry of Couch, Conville & Blitt in New Orleans. The case has been assigned to Division B Judge Cornelius E. Regan.
