Family accuses Morse village police of minor's unlawful arrest

LAFAYETTE — The family of a minor is suing village of Morse police officers alleging the unlawful arrest of that minor.

Coy Henry, Jessica Henry and Alexis Henry, on behalf of their minor child, filed a lawsuit May 30 in U.S. District Court for the Western District of Louisiana Lafayette Division against Morse Police Chief August Guillory, Jason Racca, the village of Morse and Wayne Melancon alleging unlawful arrest and illegal search and seizure. 

According to the complaint, on the evening of May 29, 2015 and early morning of May 30, 2015, Coy Henry was arrested for the kidnapping of his grandchild K.H. The suit says police officers held everyone, including juveniles, at gunpoint on the ground and seized the child from the mother, Alexis Henry. 

The plaintiffs allege the defendants unlawfully entered their house by force even though Coy Henry had been detained and/or arrested outside of the home, failed to use adequate restraint before entering the home with force and failed to use proper care when holding the juvenile children present in the home at gunpoint.

The plaintiffs seek a trial by jury, compensation for all damages, attorney fees, legal costs, and other relief as the court deems appropriate. They are represented by attorney J. Clay Lejuene of Crowley.
