MONROE — A Monroe toddlers product manufacturer is suing a competitor, alleging false advertising and unfair competition.

Luv N' Care Ltd. of Monroe filed a lawsuit June 3 in U.S. District Court for the Western District of Louisiana against Lindsay Laurian and Eazy-PZ, LLC, alleging they violated the Lanham Act and the Louisiana Unfair Trade Practices and Consumer Protection Law.

According to the complaint, Luv N' Care has suffered and will continue to suffer grave financial injury and damage unless the defendants are enjoined by the court. The plaintiff alleges the defendants used social media to disseminate false advertising, false representations and committed other acts of unfair competition, resorted to a campaign of threats and intimidation, based on a web of lies, directed at Luv N' Care and its customers and threatened to sue the plaintiff’s customers for utility patent or IP infringement if they buy plaintiff’s feeding mats.

Luv N' Care seeks a trial by jury, declaration that the ‘327 design patent is invalid and unenforceable, declaration that it violates no valid claim of defendants' design patent or any other intellectual property right of defendants, enjoining defendants from disseminating or causing the dissemination of any false or misleading representations, award of actual and punitive damages, legal costs, attorney fees and all other relief as the court deems proper. It is represented by attorneys Joe D. Guerriero, Robert M. Chiaviello Jr. and Hartwell P. Morse III of Nuby Law in Monroe.
