Woman seeks damages after accident with van

GRETNA – A Jefferson Parish woman is seeking damages after her car was allegedly backed into.

Whitney L. Kimble filed a suit against Progressive Healthcare Providers, or Progressive Healthcare Providers/Louisiana Inc., et al. in the 24th Judicial District Court on May 31.

According to the claim, the plaintiff was pulling out of the parking lot at Progressive Healthcare's Clemson House, located at 10 Sabine Court on June 30, 2015, when the incident occurred. The suit states that while pulling up to the building behind a company van, Kendra Lindsey, who was operating the van as an employee of the defendant, began to reverse. The suit states that Lindsey was on her Bluetooth phone, and while Kimble purportedly honked her horn, the defendant continued to reverse, causing a collision between the two vehicles.

Lindsey is accused of negligence in failing to keep a proper lookout, failing to make sure that there were no obstructions behind her car when reversing and overall inattentiveness. The plaintiff alleges that the remaining defendants have not paid her for damages to her vehicle.

The plaintiff is seeking an unspecified amount in damages. She is represented by Todd A. Hebert and S. Ashley Marler o Hebert and Marler in New Orleans. The case has been assigned to Division H Judge Glenn B. Ansardi.
