NEW ORLEANS – A mother and daughter who worked in asbestos abatement allege they were discriminated against by their male co-workers.

Alicia Smith de Hardy and Yariana Hardy Smith filed a complaint on June 27 in the U.S. District Court for the Eastern District of Louisiana against Brock Services LLC alleging that the employer violated the Louisiana Employment Discrimination Law.

According to the complaint, the plaintiffs allege that they were subjected to sexual harassment, a hostile work environment, discrimination based on sex, retaliation and have suffered several adverse employment actions including denial of overtime opportunities, isolation and termination of their employment on May 9, 2012. As a result, they allege they have suffered damages in the form loss of income and benefits, emotional and mental anguish and damage to their reputations.

The plaintiffs holds Brock Services LLC responsible because the defendant allegedly embarked on a concerted campaign of harassment and retaliation in an effort to get them to quit and created a hostile working environment and retaliated against them for exercising their rights for filing charges of discrimination with the Equal Employment Opportunity Commission.

The plaintiffs request a trial by jury and seek declaration that defendant's policies and procedures failed to provide an equal employment opportunity for women, reinstatement to their former positions, ordering defendants to cease the discriminatory and retaliatory practices, reasonable attorney’s fees and costs and all other legal and equitable relief deemed just and proper.
