An energy company is seeking damages after individual fails to return funds sent in error

NEW ORLEANS — An energy company is seeking damages, claiming that an individual has failed to return a check that was sent to her in error.

Mack Energy Co. filed a suit against Tina Guidry in the Orleans Parish Civil District Court on July 5.

According to the claim, the defendant received a check from the plaintiff on Aug. 22, 2014 for an amount of more than $47,000. The suit states, however, that the check was mistakenly written and mailed to the defendant and was not actually owed to her. The suit additionally states that the defendant kept the funds and has refused to return them to the plaintiff, despite being informed that the check was written in error.

The defendant is accused of failing to return funds that do not belong to her.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Karen D. Ancelet.

The case has been assigned to Division C Judge Sidney H. Cates IV, Chief Judge.

The Orleans Parish Civil District Court Case number 2016-6694.
