SHREVEPORT – A Texas corporation alleges two Oklahoma City limited liability companies owe it for its shares of the production revenue from natural gas wells.
Exco Operating Co. LP filed a complaint on July 1 in the U.S. District Court for the Western District of Louisiana, Shreveport Division against Chesapeake Operating LLC and Chesapeake Louisiana LP alleging that the well operators failed to comply with their marketing agreement.
According to the complaint, the plaintiff alleges that it has been damaged in an amount to be determined at trial. The plaintiff holds Chesapeake Operating LLC and Chesapeake Louisiana LP responsible because the defendants allegedly misappropriated more than $1.25 million of revenue owed to plaintiff from well production, improperly withheld portion of plaintiff's share of revenue payments from the wells and charged costs and expenses that are not chargeable to plaintiff under the terms.
The plaintiff requests a trial by jury and seeks judgment against defendants for all damages, costs, attorneys' fees, pre- and post-judgment interest, and all equitable relief to which it is entitled.
