Tenant files suit against Pelican Properties of Louisiana alleging son was injured

NEW ORLEANS – A man claims that faulty balcony railing at his apartment resulted in his son's fall and injury.

Troy Rollins, on behalf of his minor child, filed a suit against Pelican Properties of Louisiana LLC and property manager Benjamin Billings in the Orleans Parish Civil District Court on July 19.

According to the claim, the plaintiff's child was on the porch on the second story of his apartment on at 2501 Delachaise St. when the incident occurred on May 21. The suit states that while leaning on the railing, the railing broke and caused the child to fall to the ground and be injured.

The defendants are accused of omission and negligence through failing to maintain a safe condition of the building, failing to inspect the railing sufficiently and mismanagement of the premises.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by William E. Mura Jr. and Warren A. Forstall Jr. in New Orleans. The case has been assigned to Division G Judge Robin M. Giarrusso.
