NEW ORLEANS — A disabled Lake Charles woman is suing an insurance company, alleging violation of workers compensation acts.
Kerri L. Berlinger filed a lawsuit July 22 in the U.S. District Court for the Eastern District of Louisiana against Reliance Standard Life Insurance Company, alleging violation of the Employee Retirement Income Security Act.
According to the complaint, Berlinger has been denied the benefits due to her under the employees' group policy plan. As a result, the suit says, she has suffered and is continuing to suffer economic losses.
The plaintiff alleges the defendant unlawfully and repeatedly denied her benefits under terms of defendant’s disability policy and failed to consider Berlinger's worsening medical condition.
Berlinger seeks a trial by jury, all benefits due, pre- and post-judgment interest, attorney fees, costs of suit and all other relief the law provides. She is represented by attorneys James F. Willeford and Reagan L. Toledano of Willeford & Toledano in New Orleans.
