NEW ORLEANS — A Louisiana woman is suing Travelers Insurance and others, alleging negligence caused a tractor trailer to hit her car and cause injuries to the plaintiff.
Connie Cutrer filed a lawsuit July 21 in U.S. District Court for the Eastern District of Louisiana against Travelers Indemnity Company of Connecticut, Trojan Batter Company, and John Dempewolf , alleging Dempewolf failed to maintain reasonable and proper control of his vehicle.
According to the complaint, on Aug. 17, 2015, while Cutrer was driving on U.S. Highway 190 in St. Tammany Parish, she sustained personal injuries when her vehicle was struck by a left-turning tractor trailer operated by Dempewolf, employed by Trojan Battery and insured by Travelers.
The suit says the crash caused Cutrer to suffer injuries to her neck, back, hips and shoulders, plus mental and physical suffering.
The plaintiff alleges Dempewolf failed to ensure that the left turn could be completed safely, failed to to yield the right of way to all approaching vehicles and operated his vehicle in a reckless and negligent manner.
Cutrer seeks a trial by jury, judgment against the defendants for all damages, plus legal interest, all legal costs and all relief the court deems appropriate. She is represented by attorney Matthew D. Hemmer of Morris Bart LLC in New Orleans.
