Louisiana consumer accuses debt collector of deceptive practices

NEW ORLEANS — A Louisiana woman is suing a law firm, alleging deceptive collection practices.

Joan Baye of Houma filed a lawsuit July 29 in U.S. District Court for the Eastern District of Louisiana against The Oakes Law Firm LLC, alleging violations of the Fair Debt Collection Practices Act.

According to the complaint, on July 13, 2015, Baye received a letter from a professional law corporation confirming she had paid $10,000 toward satisfaction of a debt, and her remaining balance was $6,227.08. The suit says she continued making her monthly payments based on this information. 

On Jan. 28, 2016, the lawsuit states, she received a letter from Oakes Law, listing her current balance at $18,609.27. The plaintiff alleges the defendant falsely represented the amount of her debt.

Baye seeks a trial by jury, all damages including statuary damages of $1,000, attorney fees and legal costs, pre-judgment and post-judgment interest and such other relief as the court deems proper.
