Woman alleges she was injured by clothing rack at Chateau Drugs & Gifts

GRETNA – A couple is seeking damages over claims the wife was injured by a clothing rack while shopping in a drug store.

Stephanie Gauthier and Mark Gauthier filed a suit against Giuffria Inc., doing business as Chateau Drugs & Gifts, and ABC insurance company in the 24th Judicial District Court on July 29.

According to the claim, Stephanie Gauthier was shopping at the defendant's store in Metairie when she removed a robe from a clothing rack. The suit states that the rack then fell on the plaintiff's arm, pinning her to the ground causing her to be injured. 

Giuffria Inc. is accused of negligence through its failure to keep the clothes rack in a safe condition, failing to properly inspect the premises and failing to warn. Mark Gauthier alleges he has lost the society and consortium of his wife because of the incident.

The plaintiffs are seeking an unspecified amount in damages. They are represented by Kurt A. Offner, Roderick Alvendia, J. Bart Kelly III, Jeanne K. Demarest and Amy C. Fontenot of Alvendia, Kelly & Demarest in New Orleans.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
