NEW ORLEANS — A Livingston Parish boat captain is suing a vessel owner, alleging its negligence led to injuries for the plaintiff.

Kevin Dunn filed a lawsuit Aug. 3 in U.S. District Court for the Eastern District of Louisiana against Marquette Transportation Company LLC, alleging negligence in failing to provide a seaworthy vessel.

According to the complaint, on Aug. 21, 2015, Dunn was seriously and gravely injured while performing his duties as a captain aboard the vessel, M/V St. Rita, owned by Marquette Transportation. 

The suit says Dunn was asked to check engines and equipment in the engine room, due to what appeared to be poor performance of the engine. The lawsuit states Dunn encountered a slippery substance on the floor causing him to slip and fall, resulting in fractures to his hip and femur, which required emergency orthopedic surgery. 

The complaint says Dunn suffered loss of wages and fringe benefits, pain and suffering, loss of enjoyment of life and medical expenses. The plaintiff alleges the defendant violated its non-delegable duty to provide him with a safe place to work and failed to properly maintain the vessel.

Dunn seeks a trial by jury, monetary damages, plus costs of court and legal interest, and all other relief. He is represented by attorneys Henri M. Saunders, Scotty Chabert Jr, Cheyenne M. Moeller of Saunders and Chabert in Baton Rouge.
