Patient alleges his doctor defamed him by disclosing he had HIV to another patient

NEW ORLEANS – An HIV-positive man is seeking damages, claiming that his doctor defamed him.

Richard Turner filed suit against Bertrand Tillary Jr. MD, the Tillary Family Practice Clinic and ABC Insurance Company in the Orleans Parish Civil District Court on Aug. 16.

According to the claim, the defendant is a medical doctor who had treated the plaintiff for years. The suit states that the defendant made public a statement to another patient, Turner's former neighbor, that the plaintiff was HIV positive. The suit states that this information damaged the plaintiff's reputation.

The defendant is accused of defamation through disclosing such information to another patient.

The plaintiff is seeking an unspecified amount in damages. He is represented by Don A. Rouzan , Dana Henry and Anne E. Thomas.

The case has been assigned to Division A Judge Tiffany G. Chase.

The Orleans Parish Civil District Court case number 16-8231.
