Man alleges nose was fractured during back surgery

GRETNA – An Orleans Parish man claims that his nose was fractured during a surgery.

Michael H. Yuspeh filed a suit against Jefferson Parish Hospital Service District No. 2, doing business as East Jefferson General Hospital; Charles Davenport M.D.; Heather Carbajal; and Everett Robert M.D. in the 24th Judicial District Court on Aug. 16.

According to the claim, the plaintiff was a patient at the hospital on July 20, 2012, for surgery on his lower back. The suit states that the plaintiff's nose was fractured while under anesthesia due to negligence.

The defendants are accused of negligence through failing to provide a safe hospital setting, failing to properly handle the plaintiff's unconscious body and other acts.

The plaintiff is seeking an unspecified amount in damages. He is represented by Wayne W. Yuspeh of Metairie.

The case has been assigned to Division F Judge Michael P. Mentz.
