D&M Discount Supermarket accused of negligence after shopper falls on skateboard

NEW ORLEANS – A man claims that he fell on a skateboard in a supermarket.

Sylvester Boutin filed a suit against Danny Nassar, doing business as D&M Discount Supermarket, in the Orleans Parish Civil District Court on Aug. 22.

According to the claim, the plaintiff was a customer in the store located at 2037 N. Broad St. on Sept. 19, 2015, when the incident occurred. The suit states that the plaintiff was caused to slip and fall when he encountered a skateboard that had been left on the ground by the defendant's employee. The plaintiff states he injured his knee, leg, back and neck.

The defendant is accused of negligence through failing to inspect the area, failing to remove the danger and failing to warn customers of the danger.

The plaintiff is seeking an unspecified amount in damages. He is represented by Richard L. Olivier and Stephen Huber of Huber, Slack, Thomas and Marcelle in New Orleans.

The case has been assigned to Division G Judge Robin M. Giarrusso.
