NEW ORLEANS — A Louisiana vessel operator is suing a transportation company and an insurance firm, alleging their negligence led to the plaintiff suffering structural financial damages. 

R&S Marine LLC of Harvey filed a complaint Aug. 15 in U.S. District Court for the Eastern District of Louisiana against Dupre Marine Transportation LLC and ABC Insurance Company, alleging negligence in failing to maintain a seaworthy vessel.

According to the complaint, on May 11, 2015, R&S Marine's vessel, the M/V Warren Jr. picked up the D/B Glenn S on the east bank of the lower Mississippi River. The suit says while maneuvering in high winds, the lead barge of the defendant's MV Megan E. Dupre struck the port side of the Glenn S at approximately midship and tore a hole about 25 feet by 10 feet above the waterline. 

The lawsuit states R&S Marine settled the claim for $113,123.85. The plaintiff alleges Dupre failed to employ a properly trained captain and crew, failed to provide properly functioning equipment and failed to comply with the safety and navigational rules statutes and regulations.

R&S Marine seeks a trial by jury, judgment for all funds paid in settlement of the claim by D/B Glenn S owner, Associated Marine Equipment LLC, court costs, pre-judgment and post-judgment interest, and all other relief as justice requires.
