Two workers accuse contractor of not paying overtime

NEW ORLEANS — Two Florida men are suing a Georgia contractor, alleging failure to pay proper overtime.

Jesus Arzola and Maynor Martinez filed a class action lawsuit, individually and on behalf of all other persons similarly situated, Aug. 15 in U.S. District Court for the Eastern District of Louisiana against Rimax Contractors, Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, Arzola and Martinez normally worked more than 40 hours a week beginning in 2014 but they were not paid proper overtime pay for all hours worked in excess of 40. The plaintiffs allege Rimax treated them as exempt from the FLSA’s overtime requirements and never paid them one-and-half times their hourly rate for all hours worked more than 40 a week.

Arzola and Martinez seek a trial by jury, an order certifying this case as a collective action, all unpaid overtime wages, attorney fees and court costs, pre and post-judgment interest and all other relief the court deems equitable. They are represented by attorneys Roberto Luis Costales and Emily A. Westermeier of Costales Law Office in New Orleans and William H. Beaumont of New Orleans.
