Home Depot shopper alleges that a bag broke, dropped items and injured foot

GRETNA – A woman claims her toe was fractured after items fell out of a broken shopping bag.

Sheinita Moten filed a suit against Home Depot USA Inc., The Home Depot Inc., doing business as The Home Depot Store #359, Tanya Doe and Ashley Parker in the 24th Judicial District Court on Aug. 30.

According to the claim, the plaintiff was a guest of the Home Depot store No. 359 on Sept. 25, 2015, when the incident occurred. The suit states that the plaintiff was caused injury when the shopping bag containing some wooden items broke, resulting in a fracture to her right toe.

The defendant is accused of negligence through failing to provide the plaintiff with a bag that was sturdy enough to hold the items and failing to train employees on bagging items.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Patrick G. Kehoe Jr. of New Orleans.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
