NEW ORLEANS – A couple alleges they have been damaged after their home was repaired with contaminated Chinese drywall.
Winston J. Burns Jr. and Wendy B. Burns filed a suit against Livers Construction Inc. and Fireman's Fund Insurance Co. in the Orleans Parish Civil District Court.
According to the claim, the plaintiffs purchased a property in 1998, which sustained damages in 2005 due to Hurricane Katrina. The suit states that Livers Construction Inc. was contracted to complete repair work on the plaintiffs' property, but an inspection at the request of Fireman's Fund discovered the property was repaired with Chinese-made drywall and was causing issues. The plaintiffs allege that the defendants have refused to make repairs to the property.
The defendants are accused of breach of contract.
The plaintiffs are seeking an unspecified amount in damages. They are represented by Matthew A. Sherman and James M. Williams of Chehardy, Sherman, Williams, Murray, Recile, Stakelum & Hayes LLP in Metairie.
The case has been assigned to Division I Judge Piper D. Griffin.
