Three individuals allege landlords overcharged them for utility bills, taxes

NEW ORLEANS – Three individuals allege their landlords overcharged them for real estate taxes and utility bills for a property they rent as a restaurant.

Timothy Dubuclet, Tanya Dubuclet and Tana Montrel filed a suit against Rahim Ebrahimpour, Hossien Aghakasiri and 3340 Bienville LLC in the Orleans Parish Civil District Court.

According to the claim, the plaintiffs were renting the bottom floor of the property at 3340 Bienville St. from the defendants for use as a restaurant, and that the plaintiffs were responsible to pay their share of the real estate taxes. The suit states that the defendants failed to send tax statements to the plaintiffs for the correct portion of the building and instead sent the tax statement for the entire building to the plaintiffs, resulting in the plaintiffs overpaying for 6 years. They also allege they were sent the incorrect amounts for water and sewage for those six years as well, and the defendants neglected maintenance on the property.

The defendant is accused of breach of contract, unfair trade practices and unjust enrichment.

The plaintiffs are seeking $92,883.34 in damages. They are represented by Wm. Scott Silvey of the Silvey Law Firm in New Orleans.

The case has been assigned to Division F Judge Christopher J. Bruno.
