Shopper claims Restaurant Depot employee struck cart with forklift, caused injury

NEW ORLEANS – An Orleans Parish individual alleges his cart was struck by a forklift driver at a store and caused him injury.

Clinton Haughton filed a suit against JRD Unico Inc., doing business as Restaurant Depot, Restaurant Depot LLC, Restaurant Depot Enterprises LLC and John Doe in the Orleans Parish Civil District Court on April 28.

According to the claim, the plaintiff was caused injury on May 21, 2015, while shopping at the defendants' property at 1111 S. Broad Ave. The suit states that the plaintiff's cart was struck by a forklift being driven by an employee of the defendants, causing the cart to be pushed into him.

The defendants are accused of negligence through failing to observe what should have been seen and failure to take necessary care to prevent such incidents

The plaintiff is seeking an unspecified amount in damages. He is represented by Edward J. Womac Jr. and Matthew Sutton of the Law Offices of Edward J. Womac Jr. and Associates in New Orleans.

The case has been assigned to Division N Judge Ethel S. Julien.
