NEW ORLEANS – A man alleges an apartment he booked through Airbnb had a rotted staircase that collapsed, causing him to fall.
Andrew Callard filed a suit against American Empire Surplus Lines Insurance Co., HMIA Holdings LLC, AirBnb Payments Inc., Latter & Blum Insurance Co., Lynn S. Schwarzhopp and Mark K. Hamilton in the Orleans Parish Civil District Court on April 8.
According to the claim, the plaintiff was a customer staying at an AirBnb property owned by the defendants Schwarzhopp and Hamilton. The suit states that the plaintiff was caused personal injury on April 10, 2015, when the stairs leading to the apartment that the plaintiff was staying at collapsed, causing him to fall six feet below. The plaintiff allegedly suffered from a sprained ankle and knee and mental injuries due to the fall.
The defendants are accused of negligence.
The plaintiff is seeking an unspecified amount in damages. He is represented by Claudia Patricia Santoyo of Metairie.
The case has been assigned to Division L Judge Kern A. Reese.
