Deckhand says Jubilee Towing LLC didn't provide seaworthy vessel

NEW ORLEANS — A deckhand is suing Jubilee Towing LLC, a vessel owner, alleging negligence and insufficient measures taken to prevent injuries.

Derrell Dunmiles filed a complaint on Aug. 31 in the U.S. District Court for the Eastern District of Louisiana, alleging that Jubilee Towing LLC breached its absolute duty to furnish a seaworthy vessel.

According to the complaint, the plaintiff alleges that on Nov. 21, 2015, he was performing vessel operations when he flipped overboard and fell into the water below, sustaining serious injuries. The plaintiff holds the defendant responsible for allegedly failing to maintain the vessel and her appurtenances in a safe condition, failing to take reasonable precautions for his safety and failing to pay and/or delaying in paying the benefits of maintenance and cure.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages in an amount exceeding the jurisdictional limits of the court, pre-judgment and post-judgment interest, attorney's fees, costs of suit and all other relief to which he may be entitled.
