Fidelity Investments Institutional Services Company accused of not providing full accounting

NEW ORLEANS — An alternate payee is suing Fidelity Investments Institutional Services Company Inc., a holder of retirement accounts, citing alleged violation of pay laws.

Dorothy Murray of Terrebonne Parish filed a complaint on Sept. 1 in the U.S. District Court for the Eastern District of Louisiana against Fidelity Investments Institutional Services Company Inc., alleging that the holder of retirement accounts violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she has been unable to gain a full accounting of all funds belonging to her former spouse, Otis Murray, As a result, she alleges she has been made to suffer monetary damages, loss of benefits and emotional distress. The plaintiff holds the defendant responsible for allegedly unlawfully depriving her of retirement benefits due her as a result of a community property partition.

The plaintiff requests a trial by jury and seeks payment for monetary damages, benefits, compensatory and punitive damages, attorney’s fees, court costs and any other relief which the court deems just and proper. She is represented by Anthony T. Marshall of Marshall Law Firm LLC in Gonzales.
