Woman alleges cart caused her to fall, injure head in Lowe's parking lot

NEW ORLEANS – A shopper alleges she fell and injured her head in the parking lot of a home improvement store because of a flatbed cart.

Ann Villavasso filed a suit against Lowe's Cos. Inc., doing business as Lowe's Home Improvement, XYZ insurance company, John Doe (store manager) and unknown employees in the Orleans Parish Civil District Court on Sept. 12.

According to the claim, the plaintiff and her husband were at the store located at 2501 Elysian Fields on Sept. 14, 2015, when the incident occurred. The suit states that the plaintiff was moving a shopping cart in the parking lot when she was caused to fall due to a flatbed cart that was in the way, which caused her to hit her head on the ground when she fell.

The defendants are accused of negligence through failing clear flatbeds and shopping carts from the parking lot.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by April Davenport of New Orleans.

The case has been assigned to Division G Judge Robin M. Giarrusso.
