ALEXANDRIA – A Houma-based bank alleges it is owed more than $5 million for a promissory note.

Coastal Commerce Bank filed a complaint in the U.S. District Court for the Western District of Louisiana against M/V Randi Nichole, M/V Ms. Isabelle, M/V Ms. Bryelle, M/V Ms. Rachel Shannon, SM Energy LLC, Barbara Ann LLC, SM Energy Services LLC, Raymond J. Scully Jr. and John A. Lancon alleging that they failed to comply with the promissory note and mortgage agreement.

According to the complaint, SM Energy LLC issued a promissory note for $5,370,152.06 in February 2015 and another note for $349,000 in March 2015. The plaintiff holds M/V Randi Nichole, M/V Ms. Isabelle, M/V Ms. Bryelle, M/V Ms. Rachel Shannon, SM Energy LLC, Barbara Ann LLC, SM Energy Services LLC, Raymond J. Scully Jr. and John A. Lancon responsible because the defendants allegedly failed and refused to make any payment of the principal amount and interest due under the notes.

The plaintiff requests a trial by jury and seeks judgment against defendants for damages in the amount of $5,370,152.06, plus attorneys’ fees, and all costs and for all other relief as the court deems just and proper. It is represented by Stewart F. Peck and Joseph P. Briggett of Lugenbuhl, Wheaton, Peck, Rankin & Hubbard in New Orleans.
