Brian Gibbs Property Management employees allege they are owed unpaid overtime wages

NEW ORLEANS – Several plaintiffs alleges their Orleans Parish cleaning services employer misclassified them as independent contractors and did not pay proper overtime wages.

Aura Lecricia Torres Coronado, Paulino Ramirez Velasquez, Maria Reina Lopez, Fredy Josue Hernandez Cruz, Porfirio Fuentes Perez and Fatima Munguia filed a complaint on Sept. 14 in the U.S. District Court for the Eastern District of Louisiana against Brian Gibbs Property Management LLC, Brian C. Gibbs, Adulam Cleaning Services LLC, Henry Fajardo and Beatriz Fajardo alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that during their tenure with defendants, they regularly worked for more than 40 hours per week but were not paid overtime for the additional hours. The plaintiffs hold the defendants responsible because the defendants allegedly failed and refused to pay them proper overtime compensation at the statutory rate of one-and-one-half times their regular rate for all hours worked in excess of 40 and failed to maintain proper time records.

The plaintiffs request a trial by jury and seek compensation for unpaid overtime wages in the amount due to them, liquidated damages, attorneys' fees, costs, expenses and prejudgment interest. They are represented by Jody Forester Jackson and Mary Bubbett Jackson of Jackson + Jackson in New Orleans.
