Consumer alleges RV manufacturer sold him a defective vehicle

BATON ROUGE — A consumer is suing Highland Ridge RV Inc., a manufacturer, citing alleged breach of implied and express warranties.

David Ray Abshire filed a complaint in the U.S. District Court for the Middle District of Louisiana against Highland Ridge RV Inc. alleging that the manufacturer violated the Magnuson-Moss Warranty Act.

According to the complaint, the plaintiff alleges that, in Aug. 4, 2014, he purchased a new 2014 Open Range Bunk House for personal use. When delivered, the Open Range was defective in materials and workmanship, with such defects being discovered within the warranty periods. The defects substantially impaired its use, value and safety. The plaintiff holds Highland Ridge RV Inc. responsible because the defendant allegedly failed to perform the repair work in a good and workmanlike manner within a reasonable time.

The plaintiff requests a trial by jury and seeks rescission of the sales contract, revocation of acceptance of the vehicle, cancellation of the debt, award for attorney fees, costs and litigation expenses, prejudgment and post-judgment interest and all other relief that the court deems appropriate.
