LAFAYETTE – A restaurant patron alleges she fell and suffered a traumatic brain injury after a waitress caused her to fall.
Joan G. Hill filed a complaint on Sept. 27 in the U.S. District Court for the Western District of Louisiana Lafayette-Opelousas Division against Ruth’s Hospitality Group Inc. and American Zurich Insurance Co. alleging that defendant Ruth’s Hospitality Group failed to properly and adequately train its employee.
According to the complaint, the plaintiff alleges that on Dec. 19, 2015, she was a patron of a Ruth's Chris Steak House, operated by Ruth’s Hospitality Group, when a waitress carrying a tray and folding table struck her on her side. The incident allegedly caused her to fall and sustain injuries to her face that require various surgical procedures and a brain injury.
The plaintiff holds Ruth’s Hospitality Group Inc. and American Zurich Insurance Co. responsible because defendant Ruth’s Hospitality Group allegedly negligently positioned the dining tables in a small room and failed to instruct the employee on the various techniques to avoid such accidents.
The plaintiff requests a trial by jury and seeks award damages and losses of more than $500,000 and for all equitable relief to which she may be entitled. She is represented by James P. Lambert of Jim Lambert Law Firm in Lafayette.
