Corvette owner alleges car is defective, seeks rescission of contract

NEW ORLEANS – A man alleges that a Corvette purchased from a Slidell dealership has electrical and battery defects.

Charles E. Moore III filed a complaint on Sept. 26 in the U.S. District Court for the Eastern District of Louisiana against General Motors LLC and Robert Levis Chevrolet LLC alleging that they violated the Magnuson Moss Warranty Act, Louisiana Redhibition Laws and other counts.

According to the complaint, the plaintiff alleges that on Sept. 4, 2014, he purchased a new Chevrolet Corvette from defendant Levis Chevrolet. When delivered, the Corvette was allegedly defective in materials and workmanship and such defects substantially impaired its use, safety and value.

The plaintiff holds General Motors LLC and Robert Levis Chevrolet LLC responsible because the defendants allegedly failed to repair the vehicle so as to bring it into conformity with the warranties and failed and refused to buy back the defective vehicle.

The plaintiff requests a trial by jury and seeks the remedy of rescission of the sales contract, award for out-of-pocket expenses for related cost of repairs, diminution in value of the vehicle, litigation expenses and all other relief that the court deems appropriate.
