LAFAYETTE – Two painters have filed a class-action lawsuit against a Lafayette company alleging they were not properly compensated for overtime work.
Fredy Lanza and Lorenzo Romero filed a complaint on behalf of all other persons similarly situated on Sept. 26 in the U.S. District Court for the Western District of Louisiana against
JMA Painters LLC and Jason Thibodeaux
alleging that they violated the the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege that they normally worked more than 40 hours a week but were not properly compensated. The plaintiffs hold JMA Painters LLC and Thibodeaux responsible because the defendants allegedly never paid them one-and-half times their hourly rate for all hours worked in excess of 40 in a workweek.
The plaintiffs request a trial by jury and seek an order certifying this case as a collective action, award for all unpaid overtime wages, plus liquidated damages, attorneys’ fees and costs, prejudgment and post-judgment interest and such other equitable relief as the court deems equitable.
