Seaman alleges he was injured on vessel while lifting hatch cover

NEW ORLEANS – A seaman has filed a lawsuit against a vessel owner alleging an unsafe work environment caused him injuries.

Librado Medina-Mendoza filed a complaint on Sept. 30 in the U.S. District Court for the Eastern District of Louisiana against Tobias Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on May 10 while acting in the course of his employment and in the process of moving a heavy hatch cover of the vessel's generator owned by defendant, he sustained injuries that required medical care and treatment. He alleges he also suffered, pain, disability and mental anguish. The plaintiff holds Tobias Inc. responsible because the defendant allegedly failed to provide a safe place to work, failed to provide proper training and supervision and failed to provide maintenance and cure.

The plaintiff requests a trial by jury and seeks compensation in an amount to be determined at trial, plus interest, attorney's fees and all costs and for all other relief which the law provides. He is represented by Lawrence Blake Jones, David C. Whitmore and Stephen F. Armbruster of Scheuermann & Jones in New Orleans.
