NEW ORLEANS – A commercial finance company claims that they were not given their security deposit back.

NOLA Commercial Finance Inc. and Andrew V. Reid filed a suit against Cesar R.  Burgos in the Orleans Parish Civil District Court on Sept. 2.

According to the claim, the plaintiff and defendant entered into an agreement on Nov. 15, 2011 for the leasing of a property to the plaintiff for 37 and a half months. The suit states that the plaintiff agreed to the time period of the lease as well as the rate of the leasing. The plaintiff was unable to pay rent for a period of time and the defendant then sold the property being leased to another party, failing to inform the plaintiff of the changes. The suit states that the defendant failed to return the security deposit to the plaintiff as they ought to have.

The defendant is accused of breach of contract against the plaintiff.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Andrew L. Kramer.

The case has been assigned to Division B Judge Regina Bartholomew Woods.
