Family of Dedicated TCS employee allege wrongful death of father

NEW ORLEANS – A family is seeking damages following the death of a man on a job site.

Demond Stack, Armond Burnett, Ieasha Burnett, Pamela Burnett, Nakita Stack and Shenita Stack, individually and on behalf of the estate of Armond Stack, filed a suit against Dedicated TCS LLC, RST Insurance Co., Bulk Resources/Louisiana LLC, UV W Insurance Co., Arkema Inc. and XYZ insurance company in the Orleans Parish Civil District Court on Oct. 6.

According to the claim, the plaintiff, Armond Stack was an employee of Dedicated on Oct. 8, 2015, when the incident occurred. The suit states that the man was tasked with cleaning a tank car which, unbeknownst to him, contained hazardous and toxic vapors and he was not provided a breathing apparatus or ventilation. The suit states that Armond Stack immediately lost consciousness when entering the tank and pronounced dead later that day.

The defendants are accused of negligence and wrongful death.

The plaintiffs are seeking an unspecified amount in damages. The plaintiffs are represented by Sidney D. Torres III, Roberta L. Burns and Beau F. Camel in Chalmette and by representatives of Usry, Weeks & Matthews in New Orleans.

The case has been assigned to Division B Judge Regina Bartholomew Woods.
