LAFAYETTE – Two former employees have filed a class-action lawsuit against a company over allegations that they were not paid overtime.
Shannon Rule and Karina Esquivel filed a complaint on behalf of all others similarly situated on Oct. 7 in the U.S. District Court for the Western District of Louisiana against Southern Industrial Mechanical Maintenance Co. LLC alleging that the construction services provider violated the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege that they have not received the correct overtime rate of time-and-a-half of their regular rate for all hours worked in excess of 40 in a workweek. The plaintiffs hold Southern Industrial Mechanical Maintenance Co. LLC responsible because the defendant allegedly did not include the per diem amounts in their regular rate of pay when calculating their overtime compensation.
The plaintiffs request a trial by jury and seek compensation for unpaid back wages and liquidated damages, attorney’s fees, pre-judgment and post-judgment interest, and costs and any other relief that the court deems just.
