Man alleges accident was caused by prescription medications given to driver

GRETNA – A man alleges his left leg was amputated as a result of an accident caused by a driver still under the effects of prescribed medications.

Carl Perry filed a suit against State Farm Mutual Automobile Insurance Co. and its insured Melissa St. Blanc-Champagne; Ochsner Medical Center Westbank LLC, doing business as Ochsner Medical Center Emergency Department; ABC insurance company as insurer for Ochsner; Dr. Mark Labat M.D. and XYZ insurance company as insurer for Dr. Mark Labat M.D. in the 24th Judicial District Court on Oct. 31.

According to the claim, the plaintiff was injured on June 23, 2012, when his motorcycle was struck by St. Blanc-Champagne while traveling on state Highway 3017. He alleges St. Blanc-Champagne was previously admitted to the emergency room at Ochsner Medical Center that day and given medications, then released before she had ceased to be affected by the drugs.

The defendants are accused of negligence.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Glenn C. McGovern of Metairie.

The case has been assigned to Division D Judge Scott U. Schlegel.

The 24th Judicial District Court Case number 766106.
