Locomotive engineer alleges J. Levens Builders Inc. employee entered crossing, caused accident

NEW ORLEANS – A locomotive engineer alleges he was injured after a tractor-trailer driver entered a railroad crossing and caused an accident.

Vincent Turner filed a complaint on Oct. 18 in the U.S. District Court for the Eastern District of Louisiana against J. Levens Builders Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 9 he was operating lead locomotive in a safe manner when defendant's employee Ellen Bickham, who was operating a tractor-trailer, negligently entered the railroad crossing, causing the locomotive and train operated by plaintiff to crash into defendant's tractor-trailer. The plaintiff alleges he sustained injuries, causing him to suffer physical and mental pain, lost wages, fringe benefits and medical expenses. The plaintiff holds J. Levens Builders Inc. responsible because Bickham allegedly failed to keep a proper lookout, failed to yield to his on-coming train, negligently entered the grade crossing that caused the collision.

The plaintiff requests a trial by jury and seeks judgment against defendant for all sums reasonable in the premises, plus interest, all costs of these proceedings and for all general and equitable relief.
